Terms of Service

1. The service

MRKT DEPT is an AI marketing service. It researches your niche, plans and writes content, produces images and short videos with an AI spokesperson, sends posts to you for review, publishes approved posts to the social media accounts you connect, and can reply to comments on your posts if you turn that on. Features, limits and supported platforms may change over time.

2. Your account

You must be at least 18 and able to enter into a contract. Keep your sign-in secure and tell us about any unauthorised use. You are responsible for what happens under your account, including the actions of anyone you give access to.

3. Plans, billing and cancellation

• Subscriptions. Paid plans are billed monthly in advance through Stripe and renew automatically each month until you cancel. Prices and what each plan includes (such as the number of video posts per month and connected platforms) are shown on our pricing page and at checkout. Add-ons such as extra platforms or extra videos are billed as shown when you buy them.

• Cancelling. You can cancel at any time in the app. Unless the app says otherwise, cancellation takes effect at the end of the current billing period and you keep access until then. There are no contracts or setup fees.

• Refunds. Fees already paid are not refundable, except where the law requires otherwise.

• Monthly allowances. Post and video allowances are per billing month and do not roll over.

• Price changes. We will tell you in advance of any price change; it applies from your next billing period, and you can cancel before it takes effect.

• Failed payments. If a payment fails, we may pause or downgrade your plan until it is resolved.

• Free sample. We may offer a free sample video for each account or product so you can see the output before paying. It is offered once and may be changed or withdrawn.

4. Your content and permissions

You keep ownership of everything you provide to us — your business information, links, photos and other materials ("Your Content"). You give us a worldwide, non-exclusive, royalty-free licence to use, copy, process, adapt and publish Your Content only as needed to provide the service to you, including sending it to our service providers for processing.

You confirm that you have all the rights and permissions needed for Your Content, including the right to use any trademarks, products and images, and — for any photo of a person you upload as a spokesperson — that person's permission to create AI-generated videos and images with their likeness and to publish them.

5. AI-generated content

Subject to these terms and to your plan being paid, the scripts, captions, images, videos and replies we generate for your account ("Output") are yours to use for your business, and we assign to you any rights we have in them. Output is produced by AI and may be inaccurate, incomplete, similar to content generated for others, or unsuitable for your purposes. Review it before it is published. You are responsible for the Output you publish — including making sure that claims about your business, prices and offers are true, and that your posts comply with advertising rules and the platforms' policies. Because AI can produce similar results for different users, we cannot guarantee that Output is unique.

6. Publishing and automation

When you connect a social media account, you authorise MRKT DEPT to publish posts and, if you turn on auto-reply, to reply to comments on your own posts on your behalf. By default, posts are published only after you approve them. If you turn on auto-approve, posts are published on your schedule without further review, and you accept responsibility for them. You can switch off auto-approve and auto-reply, delete posts on the platforms and disconnect accounts at any time.

Social media platforms and our publishing partner are third-party services with their own terms. They can change their features, reject or remove posts, limit how often you post, or suspend accounts, and we are not responsible for their actions. We do not guarantee any number of views, followers, leads or sales.

7. Acceptable use

You must not use MRKT DEPT to:

• create or publish content that is illegal, deceptive, defamatory, hateful, harassing, sexually explicit or that infringes anyone's rights;

• impersonate a person or business, or use someone's likeness without their permission;

• make false or misleading claims, including health, financial or other claims you cannot support;

• post spam or manipulate a platform's systems, or break any platform's rules;

• interfere with, overload or try to gain unauthorised access to the service, or copy, resell or reverse-engineer it.

We may remove content, stop publishing, or suspend accounts that break these rules.

8. Our service and intellectual property

MRKT DEPT, including its software, design and brand, belongs to us and our licensors. These terms give you a right to use the service, not to own it. If you send us feedback, we may use it without obligation to you.

9. Suspension and termination

You can stop using MRKT DEPT and delete your account at any time in Settings. We may suspend or end your access if you break these terms, do not pay, or if we must for legal or security reasons; where reasonable we will tell you first. When your account ends, your right to use the service ends and we will delete your data as described in our Privacy Policy. Sections 4, 5, 8, 10, 11 and 12 continue to apply.

10. Disclaimers

The service is provided "as is" and "as available". To the fullest extent the law allows, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose and non-infringement, and we do not promise that the service will be uninterrupted, error-free or produce particular business results.

11. Limitation of liability

To the fullest extent the law allows, MRKT DEPT will not be liable for any indirect, incidental, special, consequential or punitive damages, or for lost profits, revenue, data or goodwill. Purposeify LLC's total liability for any claim relating to the service is limited to the amount you paid us in the 12 months before the claim arose. Some jurisdictions do not allow these limits, so they may not fully apply to you.

12. Indemnity

You agree to defend and indemnify MRKT DEPT against claims, losses and costs arising from Your Content, the Output you choose to publish, your use of the service, or your breach of these terms or of anyone's rights.

13. Changes to these terms

We may update these terms. We will post the new version here with a new effective date and tell you by email or in the app if the changes are significant. If you keep using the service after they take effect, you accept the new terms.

14. General

These terms are governed by the laws of the State of Delaware and applicable United States federal law, without regard to conflict-of-law rules, and the state and federal courts located in Delaware have exclusive jurisdiction over any dispute, except where the law of your country of residence gives you the right to bring a claim where you live. If any part of these terms cannot be enforced, the rest stays in effect. These terms, together with our Privacy Policy, are the whole agreement between you and us about the service.
